The Pup Yard Somerville (The Pup Yard LLC) - Services Agreement & Liability Waiver
This Services Agreement & Liability Waiver (the "Agreement") is entered into between The Pup Yard Somerville (The Pup Yard LLC) (hereinafter referred to as "Daycare") and the dog owner listed above (hereinafter referred to as "Owner").
1.Owner's Representations
By signing this Agreement, the Owner represents and warrants the following:
Vaccinations: My dog(s) is/are up-to-date on all required vaccinations, including Rabies, DHLPP (or equivalent), and Bordetella (Kennel Cough). I agree to provide proof of vaccination upon request and to keep them current.
Health: To the best of my knowledge, my dog(s) is/are in good health and free from any communicable diseases. I will not bring my dog to the Daycare if they are showing any signs of illness (e.g., coughing, vomiting, diarrhea).
Temperament: I represent that my dog(s) has/have not shown aggression or threatening behavior towards any person or other dog. I understand that the Daycare is a communal, off-leash environment and I am certifying that my dog(s) is/are socialized and suitable for such an environment.
Spay/Neuter: All dogs over [e.g., 7 months] of age are spayed or neutered, unless otherwise approved in writing by Daycare management.
2. Assumption of Risk & Liability Waiver
The Owner acknowledges and agrees to the following:
Owner's 100% Liability: The Owner acknowledges and agrees that while in the care and facility of the Daycare, their dog(s) remains their animal and 100% their responsibility. The Owner retains full liability for any and all actions of their dog(s). While The Pup Yard Somerville (The Pup Yard LLC) pledges to provide the best possible care and maintain a clean environment, the Owner accepts that their animal and its actions are ultimately their own liability.
Risk of Injury: I understand that dogs in a communal, off-leash environment may engage in play that can result in nicks, scratches, scrapes, or, in rare cases, more serious injuries. I also understand that dogs are animals and can be unpredictable, and I assume the risk of injury to my dog(s).
Risk of Sickness: I understand that even with vaccination requirements, my dog(s) may be exposed to communicable illnesses such as "Kennel Cough" (Bordetella), canine influenza, or parasites. I understand that Daycare cannot be held liable for the transmission of such illnesses.
Owner's Responsibility for Damage: I agree that I am solely responsible for any and all harm or damage caused by my dog(s) to any person, other dog, or property while at the Daycare. This includes, but is not limited to, medical bills and property repair costs.
Release of Liability: I hereby release The Pup Yard Somerville (The Pup Yard LLC), its owners, employees, and agents from any and all liability, financial or otherwise, for any injury, illness, or damage to my dog(s) or any property, unless such injury or damage is a direct result of the gross negligence or intentional misconduct of the Daycare staff.
3. Medical Authorization
Emergency Care: If my dog(s) becomes ill or is injured while at the Daycare, the Daycare staff will make all reasonable efforts to contact me or my Emergency Contact.
Veterinary Authorization: If I cannot be reached, I grant The Pup Yard Somerville (The Pup Yard LLC) full authority to seek immediate veterinary care for my dog(s). I grant the Daycare and its staff full power to make decisions involving the medical treatment of my dog(s).
Financial Responsibility: I agree to be fully and solely responsible for the payment of any and all veterinary bills associated with the care of my dog(s).
4. Personal Property
I agree that the Daycare shall not be liable for any lost or damaged personal property, including leashes, collars, toys, or bedding.
5. Photo & Video Release
I grant The Pup Yard Somerville (The Pup Yard LLC) permission to use photos and/or videos of my dog(s) in its marketing materials, including but not limited to its website, social media, and printed flyers, without compensation to me.
6. Agreement to Pay
I agree to pay for all services and fees at the rates designated by the Daycare. All payments are due at the time of service unless other arrangements have been made.
Client Acceptance
I certify that I have read, understood, and agree to all terms and conditions of this Agreement. I agree to be bound by its terms.
